(A) Deposit required.
(1) Each person establishing a utilities account with the town for a property owned by the person shall make a utilities deposit with the town in the amount set by Town Board resolution for each utilities account established.
(2) Each person establishing a utilities account with the town for a property not owned by the person shall make a utilities deposit with the town in the amount set by Town Board resolution for each utilities account established.
(B) Deposit period.
(1) Property owned by customer. Where the customer owns the property being served, the customer may request the return of the deposit after making 12 consecutive utility bill payments in full on or before the due date. Where the deposit was not previously returned, the town shall return the deposit upon payment of the customer’s final bill.
(2) Property not owned by customer. Where the customer does not own the property being served, the town shall return the deposit only upon payment of the customer’s final bill.
(C) Deposit application and forfeiture. When the town cuts off service to a utilities account for nonpayment of any town-provided utility and the customer has not brought the utilities account current or made payment arrangements satisfactory to the town within 15 days of the cutoff date, the town shall apply the deposit to the utilities account. The customer shall not be entitled to a refund of any amount of a deposit applied to a utilities account pursuant to this section. Where the town has applied a deposit as provided in this section, the customer shall make a new deposit prior to reconnection.
