§ 153.109 PUBLIC NOTICE REQUIREMENT.
   For all actions under this subchapter requiring a public hearing, the following public notices are required. (See § 153.173.)
   (A)   Notice shall be sent by first class mail to all real property owners owning property located within 300 feet of the property in question at least ten days prior to the public hearing; however, the failure to send or receive this notice shall not be deemed to deprive the Town Board, Planning Commission or Board of Adjustment of jurisdiction.
   (B)   Notice of the hearing shall be published in a newspaper of general circulation within the town at least ten days prior to the public hearing.
   (C)   Notice shall be posted on the subject property at least ten days prior to the public hearing. (See § 153.173.)
   (D)   All notices shall include:
      (1)   A statement of the nature of the matter to be considered;
      (2)   The time, date and place of the public hearing; and
      (3)   The agency or office and phone number where further information may be obtained.
