§ 30.23 TOWN ATTORNEY.
   (A)   Duties and responsibilities. The Town Attorney shall perform the following duties:
      (1)   Act as legal advisor to, and be the attorney and counsel for, the Board of Trustees and be responsible solely to the Board. He or she shall advise any officer or department head of the town in matters relating to his or her official duties;
      (2)   (a)   Upon request of the Board of Trustees, prosecute ordinance violations and conduct for the town cases in Municipal Court.
         (b)   He or she shall file with the Clerk of the Municipal Court copies of such records and files relating thereto;
      (3)   Prepare or review all ordinances, contracts, bonds and other written instruments which are submitted to him or her by the Board of Trustees and promptly give his or her opinion as to the legal consequences thereof;
      (4)   Call to the attention of the Board of Trustees all matters of law, and changes or developments therein, affecting the town;
      (5)   Perform such other duties as may be prescribed for him or her by the Board; and
      (6)   Unless otherwise directed by the Board of Trustees, attend all meetings of the Board and have the right to be heard upon all questions or motions before the Board of Trustees amending, repealing or in any manner affecting any ordinance in force or to be enacted by the Board of Trustees.
   (B)   Advisor/prosecutor function. The Board of Trustees may separate the Town Attorney functions of “advisor” and “prosecutor” and hire separate attorneys to provide these functions.
