(A) If a complaint has been filed in the Town Municipal Court against the owner of an impounded animal for a charge under this chapter, the animal shall not be released except on the order of the Municipal Judge, who may also direct the owner to pay all impound fees in addition to any penalties for any violation of this chapter.
(B) Any animal, which remains unclaimed for five days after its release has been authorized by the Municipal Judge, may be disposed of at the discretion of the animal shelter.
