Notwithstanding the authorization set forth in § 71.02, the following restrictions shall apply to the operation of golf carts within the town.
(A) No golf cart shall be operated by any person under the age of 16 years.
(B) No golf cart shall be operated by any person unless such person has been legally issued and possesses a currently valid driver’s license.
(C) (1) Golf carts shall only be operated on town roadways with a speed limit equal to or less than 40 mph.
(2) A golf cart may be operated to directly cross a roadway that has a speed limit greater than 40 mph at an at-grade crossing in order to continue traveling along a roadway with a speed limit equal to or less than 40 mph.
(D) No golf cart shall be operated on any state highway.
(E) No golf cart shall be operated upon any sidewalk or pedestrian trail.
(F) The number of persons allowed to travel in a golf cart shall be limited to the number of seats in the golf cart, in accordance with the design of the golf cart, but in no event shall there be more than four persons in the golf cart.
(G) Every child passenger in a golf cart shall be secured in a child restraint device as required by state law for children riding as passengers in a motor vehicle.
(H) Every golf cart operator shall possess insurance consistent with motor vehicle insurance limits required by state law, as amended from time to time.
(I) No golf cart shall be operated between sunset and sunrise or at any other time when, due to insufficient light or unfavorable atmospheric conditions, persons and vehicles on the roadway are not clearly discernible at a distance of 1,000 feet ahead, unless such golf cart is equipped and illuminated with head lamps, tail lamps and turn signals as required under the Model Traffic Code for Colorado.
(J) The operator of a golf cart shall obey all parking and traffic regulations that are applicable to motor vehicles and that have been adopted by the town.
(K) Every golf cart operated on any town roadway shall, at all times, display a slow moving vehicle emblem or a reflective flag projecting at least 12 inches from the top of the golf cart.
