For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
GOLF CART. A self-propelled vehicle not designed primarily for operation on roadways that has:
(1) A design speed of less than 20 mph;
(2) At least three wheels in contact with the ground;
(3) An empty weight of not more than 1,300 pounds; and
(4) A carrying capacity of not more than four persons.
ROADWAY. The portion of the public way that is improved, designed or ordinarily used for vehicular travel, exclusive of the sidewalk, berm, shoulder and any portion of a public way designated for exclusive use by bicycles or pedestrians. However, ROADWAY, for purposes of this subchapter, shall not include state highways.
