(A) (1) Grease, oil and sand interceptors shall be provided when, in the opinion of the Board of Trustees, they are necessary for the proper handling of any liquid waste containing grease in excessive amounts or any flammable waste, sand or other harmful ingredients, except that such interceptor shall not be required for private living quarters or dwelling units.
(2) All interceptors shall be of a type and capacity approved by the Town Manager, and shall be located as to be readily and easily accessible for cleaning and inspection.
(B) (1) When the Board of Trustees determines that a grease, oil or sand interceptor is necessary, the Town Manager, or his or her designee, shall personally serve a written notice and order on the owner or the occupant of the real property at which the inceptor is required. The written notice and order shall require that an interceptor be installed within 90 days. If diligent efforts to serve the written notice and order personally are unsuccessful, it shall be deemed sufficient notice if the written notice and order is mailed by first class mail to the owner of the real property, as shown in the records of the County Assessor, and the occupant at the real property address.
(2) If the notice and order are not complied with by the date set forth therein, the town may:
(a) Institute the appropriate proceedings in law or in equity to restrain, correct or abate such violation;
(b) Discontinue water service to the property served except that, prior to the discontinuance of water service, at least ten days’ notice and an opportunity to be heard before the Town Manager shall be given; and/or
(c) Issue a summons and complaint to the person alleged to be in violation of this section and order such person to appear before the Town Municipal Judge.
