(A) Keeping dangerous animals outside an enclosure is prohibited. It shall be unlawful for any person to chain or keep a dangerous animal within the City of Wickliffe outside a proper enclosure. It shall be unlawful for any person to keep or harbor within the city a dangerous or vicious dog unless it is at all times kept securely chained or enclosed in such a manner that it cannot escape from the owner’s premises.
(B) (1) Such enclosure must have a minimum dimension of five feet by ten feet per dog and must have secure sides and a secure top. If it has no concrete, cement or asphalt bottom, the sides must be imbedded into the ground no less than two feet.
(2) The enclosure must also provide protection from the elements for the dog.
(3) A vicious dog shall be transported to or from the indoors and securely enclosed and locked in an outdoor pen or shelter only if such dog is muzzled and restrained by a suitable chain or leash not exceeding six feet in length and under the control of a responsible adult. The muzzle must be made in a manner that will not cause injury to the dog or interfere with its vision or respiration, but will prevent the dog from biting any person or animal.
(C) In addition, no landlord or landlord agent shall permit any tenant to move in a vicious animal into any building or premises owned or controlled by the landlord or landlord agent. No landlord or landlord agent shall normally permit any person to keep any vicious dog in any building or premises owned or controlled by the landlord or landlord agent, unless it complies with the enclosure requirements. Any landlord or landlord agent learning of any vicious dog in any building or premises owned or controlled by the landlord or landlord agent shall notify the person having such dog to remove the dog from the city immediately.
(D) Visitors staying in the City of Wickliffe will be required to comply with the terms of this subchapter once they have been informed concerning the city’s requirements on dangerous or vicious dogs by the City Clerk, city or county law enforcement officers or the county dog warden.
(E) It shall be unlawful for any owner or keeper to keep or harbor any dog that barks or yelps or otherwise makes such noise as to disturb the peace and quiet of the neighborhood.
