(A) Since Wickliffe is a small community the wealth of qualified personnel within the area and the pay scale could limit the selection process. Therefore, this must be taken into consideration under the nepotism clause. The two main factors that must be addressed are “qualified” and “payscale.”
(1) A person can be employed by the city if she/he meets or exceeds the qualifications being used for the position being considered. However, all other applicants must be judged on the same basis.
(2) Relatives (husband, wife, children, parents, brothers or sisters) involved will in no instance use their position to influence the Mayor, Council Members, Clerk-Treasurer or Supervisor in the selection process.
(3) In the case of a relative being recommended by the selection process, it is recommended that the Mayor and Council will agree on the recommendations by a two thirds majority. In no way will this clause alter the selection process under current state law (fifth class) if the Mayor does not wish to seek approval or a two-third Council approval.
(4) During the period of employment and advancement, the Mayor may place restrictions on job duties and responsibilities if a conflict of interest or other problems could occur in the case of related employees.
(B) Penalty for violation of this article could be the discharge of the related employee if the Enforcement Committee finds a violation after their investigation. A further recommendation that legal action be taken against the Mayor, Council and employees would also be in order if the Committee finds gross violations.
