§ 37.02 CONFLICT OF INTEREST.
   An elected or nonelected officer or employee of the city shall not intentionally participate in the discussion of, vote, or make a decision in his official capacity on any matter:
   (A)   In which the elected or nonelected officer or employee, or any family member, (husband, wife, children, parents, brothers or sisters) or business associate will derive a direct monetary gain or suffer a direct monetary loss as a result of the officer's or employee's vote or decision; or
   (B)   No elected or nonelected officer or employee or any family member of an elected or nonelected officer or employee shall have an interest in a business or engage in any business, transaction, or activity, which is in substantial conflict with the proper discharge of his or her duties in the public interest which relates specifically to a business in which the officer or employee owns or controls an interest of $10,000 or more, or an interest of more than 5%.
   (C)   No elected or nonelected officer or employee shall use or attempt to use his or her official position to secure unwarranted privileges or advantages for himself or others.
   (D)   No elected or nonelected officer or employee shall be deemed in violation of these provisions if, by reason of the elected or nonelected officer's or employee's participation, vote, decision, or inaction, no monetary or material gain accrues to the elected or nonelected officer or employee, a family member, or a business associate, as a member of any business, occupation, profession, or other group, to any greater extent that any gain could reasonably be expected to accrue to any other member of the business, occupation, profession, or other group. Nothing in these provisions shall prohibit an elected officer from voting on matters affecting his or her compensation, expenses, benefits, and allowances, as provided by law.
   (E)   Every elected or nonelected officer and employee who has a prohibited financial interest which he or she believes or has reason to believe may be affected by an official action taken within the scope of his or her employment, including any vote or decision, shall disclose the precise nature and value of the interest, in writing, to the governing body and the disclosure shall be entered on the official record of the proceedings of the governing body. The officer or employee shall refrain from taking any official action with respect to the matter that is the subject of the disclosure. Penalty for the violation of this chapter will be the cancellation of any contract etc., repayments or removal from office, job or board/committee or a verbal or written reprimand as the Enforcement Committee deems appropriate.
