(a) No society, club, organization, nonprofit corporation, individual or entity shall engage in conduct that facilitates any game of chance within the City limits without first obtaining a permit from the Chief of Police.
(b) An application for a permit to facilitate a game regulated hereunder shall be made at the office of the Chief of Police on a prescribed form no later than thirty days in advance of the proposed event date. [Said “Application” (Exhibit A) and “Rules and Regulations” (Exhibit B) are attached to Ordinance 2008-39]. The application shall contain, at a minimum, the following information:
(1) The name of the person, group, corporation, association or organization conducting the game;
(2) The location at which the game is to be conducted;
(3) The number of days and specific dates and times that the game is to be conducted. The duration must comply with the limits prescribed herein and with Chapter 2915 of the Ohio Revised Code;
(4) The date and nature of any past game of chance or scheme of chance held by the applicant;
(5) Proof that the applicant satisfies the definition of a charitable organization prescribed herein at Section 517.01

(6) The name, address and telephone number of the custodian of the records for any game held pursuant to this chapter. Records shall be maintained in accordance with the regulations prescribed herein and in Ohio R.C. 2915.10.
(c) Any violation of this section shall be a misdemeanor of the first degree.
