§ 91.040 IMPOUNDMENT AND DISPOSITION.
   (A)   All animals found running at large shall be taken up by the Chief of Police, any police officer, or any animal control officer and impounded for a period of not more than three days. Animals impounded and not claimed by their owners at the expiration of three days may be disposed of at the discretion of the Chief of Police, any police officer, or any animal control officer.
   (B)   When animals are found running at large and their ownership is known to the Chief of Police, any police officer, or any animal control officer, such animals need not be impounded, but the officer may cite the owner of such animals to appear in court to answer to violations of this subchapter. Immediately upon impounding animals, the Chief of Police, any police officer, or any animal control officer shall attempt to notify the owner of such animal so impounded and inform such owners of the conditions whereby they gain possession of such animals. If any owner has requested his or her animal be destroyed, the animal shall be destroyed in a humane manner at the owner’s expense.
