In the event a person shall fail to abate any nuisance created, permitted, or maintained by him or her following written notice to him or her to do so, the Chief of Police, or other city official, shall cause such nuisance to be abated. The city may file a civil suit, as allowed by state law, to abate any nuisance and may recover expenses, including reasonable attorney fees and costs, incurred by the city in abating any nuisance from the person creating, permitting, or maintaining the same, or the person owning the real estate, in the same civil suit.
