The Department may exempt the city and its contractors and the North Carolina Department of Transportation (NCDOT) from particular requirements in §§ 157.03 through 157.06 when substantial compliance has been assured through the city’s contracting system or, in the case of NCDOT, where the need for state infrastructure on city roads, or a joint undertaking by the city and NCDOT, or the use of state controlled areas of the PROW makes the application of such requirements unreasonable.
