(A) In the event of a violation of this section, or any conditional use permit or administrative approval issued pursuant to this section, the city may impose and collect, and the holder of the conditional use permit or administrative approval for a wireless telecommunications facility or complex shall pay to the city, fines or penalties as set allowed by state law or as otherwise established by the city.
(B) Notwithstanding anything in this section, the holder of the conditional use permit or administrative approval for a facility or complex may not use the payment of fines, liquidated damages or other penalties, to evade or avoid compliance with this section or any section of this chapter. An attempt to do so shall subject the holder of the conditional use permit to termination and revocation of the conditional use permit in addition to the payment of fines. The city may also seek injunctive relief to prevent the continued violation of this section without limiting other remedies available to the city.
