§ 155.240 APPOINTMENT AND TERMS OF BOARD OF ADJUSTMENT.
   (A)   As of November 14, 2017, the City Planning Board will assume the duties of the Board of Adjustment The Planning Board members serving as of the date listed above shall serve in a dual capacity, both as Planning Board and Board of Adjustment members.
   (B)   Members may be reappointed to successive terms without limitation.
   (C)   All members may participate in and vote on all issues before the Board, regardless of whether the property involved is located within the city or within the extraterritorial planning area.
   (D)   All members appointed to the Board of Adjustment shall, before entering their duties, qualify by taking an oath of office as required by G.S. § 160D-309.
   (E)   Proportional representation of populations within the extraterritorial area shall be provided by appointing residents of the entire extraterritorial planning and development regulation area to the Board of Adjustment with a minimum of one resident appointed from the extraterritorial area. The population estimates for this calculation shall be updated no less frequently than after each decennial census.
