§ 85.16 BOND OR CASH DEPOSIT.
No permit shall be issued under this subchapter until the applicant has deposited with the city a bond, payable to the city and in an amount sufficient, in the judgment of the city, to cover the cost of filling the excavation and restoring the surface to its original condition. The bond shall be executed by an insurance or bonding company authorized to do business in this state. If the city determines that the city shall do the work, then the applicant for the permit may make a cash deposit with the city in lieu of furnishing the bond. In either case, the cost of filling the excavation and restoring the surface shall be borne by the permit holder.
