§ 51.006 WATER AND SEWER RATES.
   (A)   The fees for water and sewer rates for residential, commercial and industrial consumers shall be set by City Council, reviewed periodically, and are to be maintained in the Schedule of Fees in § 21.06.
   (B)   For the purposes of this section, the following terms, phrases, words and their derivatives shall have the meaning given herein. The word “shall” is also mandatory and not merely directory.
      ACCOUNT TRANSFER FEE. Paid when service is transferred from one address to another for an existing customer.
      AVAILABILITY FEE. A minimum monthly charge will be assessed to property owners of residential housing and commercial units for the provision of basic fire and public utility services, including hydrants, fire flow and fire suppression capability. The fee shall be assessed per unit served and based on the minimum monthly charge for utility services, as set forth by the Mayor and City Council. If more than one unit is served by one water meter, as provided for in § 51.008, the AVAILABILITY FEE shall be assessed for each unit served.
      CUT-OFF. All delinquent accounts that remain unpaid on the tenth will be deemed past due and service will be terminated until the outstanding balance is satisfied. A service charge shall be applied to all delinquent accounts that remain unpaid of the tenth or the next applicable business day if the tenth on a weekend or an official city holiday.
      DUE DATE. Utility charges shall be due and payable on the tenth day of each month or the next applicable business day if the tenth falls on a weekend or official city holiday.
      METER/HYDRANT TAMPERING FINE. Charged for tampering with a city meter or hydrant. TAMPERING includes physical abuse; unauthorized connection, reconnection or sharing of services; and other forms of utility distribution misuse.
      NON-RESIDENTIAL ACCOUNTS. City utility accounts for non-residential accounts shall include the following services: water, sewer and sanitation.
      RESIDENTIAL ACCOUNTS. City utility accounts for residents shall include the following services: water, sewer, sanitation, recycling, and leaf and limb.
      SERVICE CHARGES.
         (a)   Assessed for the following city services:
            1.   Administrative processing of past due accounts and/or service disconnections; and
            2.   Customer-requested meter read in excess of one per three-month period.
         (b)   There will be no service charge for service cancellations or verifiable leakage repair.
      UTILITY DEPOSIT. Required to provide security for water, sewer and refuse collection service provided to rented or leased properties, both residential and commercial.
