§ 41.099 RESPONSIBILITY FOR ABATEMENT EXPENSES.
   The expense of the abatement of a hazardous materials emergency or an intentionally caused fire shall be charged to and paid by the person owning, storing or transporting the hazardous materials which were released or by the person whose intentional act caused the fire. Expenses shall include the actual labor costs, fringe benefits, administrative overhead, costs of equipment, costs of disposal, the cost of any contract labor and materials and the costs, including attorney’s fees, of collecting paid expenses.
