Any single-family dwelling unit, multiple-family dwelling unit or commercial establishment which is occupied or in operation, constitutes prima facie evidence that solid waste is being produced and accumulated on the premises and service charges for the collection and disposal thereof are due the city; provided, however, the presumption may be rebutted by presentation of evidence that solid waste is collected and disposed of by the owner of the building or the landlord or by other appropriate means approved by the City Manager or his or her duly authorized representative.
