(A) This chapter shall be enforced by an administrative Zoning Officer to be designated by Council.
(B) It shall be his or her duty to:
(1) Enforce the provisions of this chapter;
(2) Accept applications for permits; and
(3) Issue permits with the approval of a Review Board consisting of any three members of the Planning and Zoning Commission.
(C) (1) The City Zoning Officer shall have full authority to enforce all zoning regulations of the city.
(2) The procedure for enforcement by the Zoning Officer shall be as follows.
(a) The Zoning Officer is hereby empowered and authorized to issue a citation for a violation of any of the city’s zoning regulations without assistance from the City Police Department or any other municipal agency, employee or elected official.
(b) Within ten days after receiving a citation alleging a violation of a zoning regulation, the recipient of such citation may file an appeal of the Zoning Officer’s decision with the city’s Board of Zoning Appeals.
(c) Within 60 days of receiving such appeal, the Board of Zoning Appeals shall take all action required by law, including any required publication and hearing, and issue a decision either upholding or overruling the decision of the Zoning Officer.
(d) If no appeal to the Board of Zoning Appeals is made, or if the Board of Zoning Appeals affirms the decision of the Zoning Officer, the matter may proceed to Municipal Court in the same manner as any other violation of a city ordinance is prosecuted in Municipal Court. The Zoning Officer shall be the witness, and no assistance from the City Police Department or any other municipal agency, employee or elected official may be required in the prosecution of the matter, other than the usual Municipal Court personnel.
(e) Under no circumstances shall the Zoning Officer be entitled or authorized to issue or execute an arrest warrant on anyone, nor shall the Zoning Officer have any authority to make an arrest.
