(A) The city shall be responsible for the collection and disposal of all solid waste generated within the corporate limits of the city. The actual collection, removal and disposal of solid waste shall be performed either by city forces or an independent contractor.
(B) The Mayor in his or her discretion, after considering which method would be the most feasible, efficient and economical to the city, may recommend to Council that collection, removal and disposal of solid waste generated within the corporate limits of the city be done by city forces or be performed by an independent contractor with such independent contractor having either exclusive rights or non-exclusive rights to collect, remove and dispose of solid waste within the city, or that such independent contractor have exclusive or non-exclusive rights to collect, remove or dispose of solid waste in certain areas or districts or to certain classifications of occupants or owners and to recommend withholding these rights as to other classifications of occupants or owners. The final determination to use city forces or an independent contractor shall be made by Council through motion.
(C) The Mayor or his or her duly authorized representative is hereby empowered to adjust, settle or cancel any charge or fee required or made under this subchapter or any controversy which may arise in the administration of this subchapter or out of any contract between the city and any contractor either on behalf of the city, contractor or any other person. However, such exercise of this authority by the Mayor shall be in a uniform manner and not in a capricious or arbitrary fashion and a log shall be kept of any adjustments, settlement or cancellation and open to inspection by Council.
(D) All collections shall be made as quietly as possible and no unnecessarily noisy trucks or equipment shall be used. Employees of the city or of any independent contractor who are unnecessarily noisy, abusive or threatening to the public or who violate any ordinance of this city shall be dismissed by the Mayor if city employees, or upon the demand of the Mayor if employees of an independent contractor.
(E) The independent contractor shall not permit any agency, employee or subcontractor employed by him or her to request, demand or accept either directly or indirectly any compensation or gratuity from any person, firm or corporation other than the city for collections made, except as otherwise herein provided.
