§ 35.04  NOMINATIONS.
   (A)   Conduct of election. Municipal elections under this chapter shall be conducted as follows. Any person registered to vote in the municipality otherwise eligible to hold office may become a candidate and have his or her name placed upon the ballot, upon his or her own motion, by filling with the City Recorder a declaration of his or her candidacy and a certification of his or her eligibility, duly acknowledged by him or her, filing period, starting the second Monday of January, and ending the last Saturday of January. Such declaration may be mailed but must be postmarked before midnight on last Saturday in January. Such declaration may be by accompanied by an announcement fee as follows: if a candidate for Mayor, the fee shall be $10; if a candidate for Recorder, the fee shall be $7.50; and if the candidate for Council member, the fee shall be $5; which fee shall be paid to the Recorder, who shall pay the same over to the City Treasurer. The names of all candidates for elective offices of the city shall appear on one ballot at the election in June 2003, and every two years thereafter. The ballot shall be without party emblem or designation.
   (B)   Form. The form of the declaration of candidacy and certificate of eligibility of candidates shall be substantially as follows:
I, _________________, hereby certify that I am a candidate for the office of __________ and desire my name printed on the official ballot to be voted for at the city election to be held on the _______________ day of __________, 20_____; that I am a registered voter of the City of White Sulphur Springs, County of Greenbrier, State of West Virginia; that I am eligible to hold the said office; and that I am a candidate for said office in good faith.

   (C)   Drawing of ballot position. Ballot positions are determined by a required drawing for ballot position for an office whenever more than one candidate has filed. The drawing shall be held the fourth Tuesday after the end of the filing period in Council Chambers, City Hall at 9:00 a.m.
   (D)   Withdrawal of candidate. A candidate who wishes to file a withdrawal must be by written statement received by the Recorder by the third Tuesday following the close of the filing to be removed from the ballot.
