11.48.020: STORING, PARKING OR LEAVING VEHICLES ON PUBLIC OR PRIVATE PROPERTY:
   A.   No person shall:
      1.   Abandon a vehicle.
         a.   A vehicle shall be considered abandoned which has been left unattended and:
            (1)   Is positioned on property not intended to support motor vehicles; or
            (2)   Has been inoperable for forty eight (48) hours on public property not immediately adjacent to private property owned, rented, or leased by the vehicle's owner; or
            (3)   Has remained on private property not owned by the vehicle's owner without the consent of the property owner or person in control of the property for more than forty eight (48) hours; or
            (4)   Is more than five (5) years old and has remained on a designated County, State, or Federal right-of-way for more than forty eight (48) hours; or
            (5)   Is five (5) or less years old and has remained on a designated County, State, or Federal right-of-way for more than ninety six (96) hours.
      2.   Park a vehicle on public property, which:
         a.   Does not have a valid and current registration issued from the Nevada Department of Motor Vehicles or another state or nation; or
         b.   Does not appropriately display a valid and current license plate, temporary placard, or moving permit issued for that vehicle by the Nevada Department of Motor Vehicles or by another state or nation; or
         c.   Is suspended on jacks or any other lifting device, except as and to the extent reasonably necessary to change a tire or effect an immediate repair; or
         d.   Is disassembled or engaged in mechanical repairs, except as to the extent reasonably necessary to effect an immediate emergency repair.
      3.   Allow a junk vehicle to remain:
         a.   Unmoved on public property for more than seventy two (72) consecutive hours without:
            (1)   Notifying the Sheriff of the County; and
            (2)   Obtaining written approval for the vehicle to remain;
         b.   On any adjoining public property adjacent to the same parcel or property line for more than seventy two (72) hours of any consecutive ninety six (96) hour period without:
            (1)   Notifying the Sheriff of the County; and
            (2)   Obtaining written approval for the vehicle to remain;
         c.   In a parking space in the parking lot of a multifamily residential development for more than seven (7) consecutive days if the vehicle:
            (1)   Is in an obviously mechanically inoperable condition or a state of disassemble; and
            (2)   Is visible from public property.
      4.   Park any vehicle in the White Pine County Courthouse, Sheriff, and/or Detention Facility parking lot(s) located at 1785 and 1786 Great Basin, Blvd., Ely, Nevada, between the hours of ten o'clock (10:00) P.M. and five o'clock (5:00) A.M. (of the succeeding day), except for County owned vehicles, vehicles owned or operated by County Employees, Law Enforcement Officers, and/or persons conducting official, after-hours business at the Courthouse, Sheriff, and/or Detention Facilities.
         a.   The daily hours designated for closure to public use of the White Pine County Courthouse, Sheriff, and/or Detention Facility parking lot(s) located at 1785 and 1786 Great Basin, Blvd., Ely, Nevada, that is, between the hours of ten o'clock (10:00) P.M. and five o'clock (5:00) A.M. (of the succeeding day), shall be posted (by signs) in conspicuous places at each of the facilities, including, but not limited to, areas commonly used for public ingress and egress of vehicles, intervals of such a distance as is necessary to ensure that at least one such sign would be within the direct line of sight of a person standing next to another such sign, but at intervals of not more than five hundred (500) feet.
         b.   This provision shall apply, without limitation, to any and all current and future public Courthouse, Sheriff, and/or Detention Facility parking lot(s), owned or controlled by White Pine County, including, but not limited to those located within the city limits of the City of Ely, Nevada.
         c.   Any person who violates this provision shall be guilty of a misdemeanor and may be punished according to White Pine County Code Section 10.28.030 and the vehicle is subject to towing and storage at the vehicle owner's expense.
   B.   For purposes of the forty eight (48), seventy two (72), and ninety six (96) hour limitations contained in this chapter, vehicles which are moved short distances with the intent of avoiding the time limitations will be considered in violation. (Ord. 528 § 1, 2022: Ord. 473, 2017)
