8.04.410: "MICROCHIP" IMPLANTATION:
   A.   "Microchip" Defined: "Microchip" means a passive sterile transponder bearing a unique alphanumeric code, capable of electronic detection, borne within a glass outer casing, or other substance having properties of biocompatibility, capable of injection into the subcutaneous tissue of puppies and dogs, or cats over the age of six (6) months, for purposes of identifying an animal.
   B.   General Microchip Implantation Not Required: Except as otherwise provided herein, microchip implantation shall not be made mandatory upon the owners of any animal subject to the licensing requirements of this chapter.
   C.   Circumstances Requiring Mandatory Microchip Implantation: Any court, when enforcing the provisions of this chapter, shall require that the owner of an animal which has inflicted a bite upon any person to have a microchip implanted in such animal at the owner's expense.
   D.   Circumstances Allowing Discretionary Microchip Implantation: Any court, when enforcing the provisions of this chapter may direct the owner of an animal which has once been at large, to have a microchip implanted in such animal at the owner's expense. Any court, may also direct that the owner of an animal have a microchip implanted where determined that interests of public health and safety will be protected by such action.
