6.02.080: CITY DUMP SITES; REQUIREMENTS:
The franchisee shall be required to provide at least one suitable location as a city dump site for the purposes of dumping and burying garbage, as well as trash and waste matter. For this purpose, the city shall make available to the franchisee the east one-half of the northwest one-quarter of section ten, township 16 north, range 63 east, M.D.B. & M., owned by the city, for the disposal of garbage, trash and waste matter. In addition, the franchisee may request the city council to designate, in writing, such other city dump sites as may be advisable. In no event, however, shall the franchisee be required to make available for use by the public more than one city dump site. The franchisee shall not be entitled to use any city dump site, whether the one described above or such other city dump sites as may be designated by the city council, for any other purpose than dumping or burying garbage, trash and waste matter. Citizens and residents of the town of Ruth, town of McGill, and within one mile on each side of the McGill Highway and the Ruth Highway, shall be entitled to haul and dump their own trash and waste matter on any and all city dump sites made available by the franchisee, passes for which will be furnished by the franchisee to those customers who have kept account with the franchisee current. All garbage, trash and waste matter deposited on any and all city dump sites shall be buried in the landfill method prescribed by state law. Any and all city dump sites, whether made available to the public or not, shall be kept free of all paper and other material, shall not be allowed to become unsanitary, filthy or dangerous to the health of the general public, and shall be kept in the condition required by the laws of the state and the city-county district health department of White Pine County. Any and all city dump sites shall be maintained in a manner so as to prohibit or limit access to a dump site, by means of fences or other similar methods. The franchisee shall have the right to all salvage of any matter whatsoever that may be collected from any and all city dump sites, however deposited thereon. (Ord. 11/6/74 §6(2)(a), 1974)
