1.08.010: FINDINGS:
The board of White Pine County commissioners finds that:
   A.   The several and various estates in property situated within White Pine County, Nevada, have value;
   B.   All affected segments of the American public, whether acting through federal, state or local governments, have an obligation and a legal right to acquire and pay compensation, through eminent domain, for all or portions of estates in property situated in White Pine County, Nevada, which are necessarily taken for public purposes;
   C.   Government taking of property without compensation unjustly infringes constitutionally protected property rights, restricts the reasonable use of property, and causes a few property owners to bear a burden rightfully and legally the responsibility of all;
   D.   Property rights in White Pine County, Nevada, are being subtly diminished through gradual application of laws, regulations and other legal actions of government at all levels which, in the aggregate, adversely affect their value and their owners' ability to make legal and reasonable use of private property and substantially diminishes the county's tax and economic bases;
   E.   Protection of wilderness, natural, riparian, pristine, and wetlands areas, as well as of endangered species, clean air corridors, clean water sources, view sheds, and other like values, are noble actions, but result in many property rights being taken from their owners and from the county's economic and tax bases for the benefit of the American public at large;
   F.   Owners or trustees of property situated in White Pine County, Nevada, should be able to fully recover compensation for government taking of their property;
   G.   Governments' administrative appeal processes provide means for contesting government administrative actions, but do not provide a means for just resolution of taking claims; and
   H.   Owners of property situated in White Pine County, Nevada, should be able to commence court action immediately following actual and concrete injury, to recover just compensation for government taking of their property. (Ord. 339 §1, 1999)
