§ 31.35 POWERS AND DUTIES.
   (A)   The Board of Zoning Appeals shall have the following powers and it shall be its duty to:
      (1)   Hear and determine appeals from and review any order, requirement, decision or determination made by the Plan Commission in the enforcement of any ordinance or regulation adopted pursuant to Sections 56 through 65, inclusive, of the Planning Act of 1947.
      (2)   Permit and authorize exceptions to the district regulations only in the classes of cases or in particular situations as specified in the ordinance.
      (3)   Hear and decide special exceptions to the terms of the ordinance upon which the Board is required to act under this chapter.
      (4)   Authorize upon appeal in specific cases such variances from the terms of the ordinance as will not be contrary to the public interest, where owing to special conditions, fully demonstrated on the base of the facts presented, a literal enforcement of the provisions of the ordinance will result in unnecessary hardship and so that the spirit of the ordinance shall be observed and substantial justice done.
   (B)   In exercising its powers, the Board may reverse or affirm, wholly or partly or may modify the order, requirement, decision or determination appeal from as in its opinion ought to be done in the premises and to that end shall have all the powers of the Plan Commission from whom the appeal is taken.
   (C)   The Board shall hear and determine appeals in the manner prescribed in Sections 78 to 81 inclusive of the Planning Act of 1947.
