§ 50.11 PROCEDURE AND FEES FOR INVESTIGATION OF A STORM WATER NUISANCE.
   (A)   Pursuant to I.C. 36-9-28.7 ("the Act"), the Town Council hereby designates the Storm Water Management Department ("Department") as the body of town government to conduct an investigation into an alleged storm water nuisance.
   (B)   An application for such an investigation shall be filed with the Department on forms provided by the Department (the "petition"). Failure or refusal of the requestor to submit the petition provided by the Department shall be deemed a withdrawal of the request for an investigation.
   (C)   The costs of the investigation shall be paid by the town, and the requestor of the petition shall not be responsible for any fees or costs incurred by the Department in conducting the requested investigation needed to complete the work necessary to arrive at the report contemplated by the Act (the "report").
   (C)   The report shall be provided to the requestor upon the conclusion of the Department's investigation.
