§ 50.87 AVAILABILITY FEES AND CONNECTION FEES.
   (A)   General provisions; definition.
      (1)   No connection to the town's sewage works system shall be allowed until a permit is obtained and payment of availability fees and connection fees has been made to the town, except as provided in this section.
      (2)   AVAILABILITY FEE is the charge to a user for a new or additional connection to the town's sewage works system and is charged in return for the town making available to such user the town's sewage works system consisting of all facilities and operations necessary to pickup, transport and treat sewage of such user.
   (B)   Availability fee established. The availability fee is hereby established in the amount of $2,250 per Equivalent Domestic Unit (EDU). The classification set forth in the table for estimating wastewater flows shall be used to calculate the estimated wasteload allocations or capacity and for determining the number of EDU’s the owner, lessee, or developer shall pay the availability fee according to the following schedule:
      (1)   Developments - inside city limits. One-third of the availability fee, upon the latter of the approval by the Whiteland Plan Commission of a commercial site development for real estate located inside the town limits or being annexed or the acceptance of performance or maintenance bonds for public sanitary sewer improvements, with the balance of the availability fee due per EDU upon the application of an improvement location permit for each EDU that a permit is requested.
      (2)   Other developments - inside town limits. One-third of the availability fee, upon an approval by the Town Council for sewer service, if none of the above applies, with the balance of the availability fee due per EDU upon the application of an improvement location permit or sewer connection permit for each EDU that a permit is being requested.
      (3)   Miscellaneous. All of the availability fee, upon the application for an improvement location permit or sewer connection permit when no portion of an availability fee has been paid for said connection of the real estate.
      (4)   Classification change.  
         (a)   All of the availability fee, upon the application of an improvement location permit or from an increase or changed use on the real estate resulting in a greater classification of estimated wastewater flows.
         (b)   The balance of an availability fee due shall mean the amount due based upon the estimated wasteload as outlined in this section and the availability fee in existence at the time payment is due to be made. The Town Council, or their designee, shall be permitted to round figures so to express the availability fee in whole dollars.
      (5)   Other developments - outside town limits. The Town Council shall determine, on a case by case basis, what the availability fee shall be.
      (6)   Equivalent Domestic Unit (EDU); table of estimated flow, availability fee calculation.
         (a)   One EDU is equivalent to the estimated average daily sewage flow for a standard single family residence within the town's sanitary sewer system, which is 310 gallons per day (gpd).
         (b)   For the purpose of determining the estimated average flow in gallons per day for users other than a standard single family residence and for purposes of calculating the availability fee, the number of EDU’s for a user, other than a standard single family residence, shall be determined according to the table below, which estimated flow shall be divided by 310 gpd to derive the number of EDU’s and to calculate the resulting availability fee:

If there is no appropriate estimate flow classification listed above, then the Town Council or its designee shall determine the estimate average flows based upon engineering judgment and reasonable information.
 
         (c)   The Availability Fee Infrastructure and Capacity Fund (hereinafter “AFICF Fund") is hereby created and all the revenues generated by the AF shall be deposited in said fund. All interest earned on monies in the AFICF Fund shall be credited to said Fund. The AFICF shall not be considered as net revenue of the sewage works and may be expended for designated infrastructure capital projects and the associated professional services necessary for said projects to provide the town with additional capacity. The Town Council may utilize the monies in the AF Fund to pay debt service on bonds issued to finance designated infrastructure, capital projects, the associated professional services necessary for said capital projects to provide the town with additional capacity, and pay direct administrative expenses associated with establishing or operating the collection of the AFICF.
   (C)   Town Council to make rules and regulations for availability fee and related matters.
      (1)   The Town Council is hereby authorized to make rules and regulations for the determination, processing, implementation and collection of the AF, but is not limited to, establishing procedures and approving forms and agreements for the AF.
      (2)   The amount of the availability fee may, from time to tine, be changed by the Town Council.
   (D)   Sewer connection fee, also sometimes known as a "tap-on" or "hook-on” fee. Any user connecting to the sewage works shall pay a connection fee based upon the diameter size of the water meter installed at the premises as follows:
      For each inch or ¾ inch or less size water meter: $650
      For each water meter larger than ¾ inch but less than 2 inches: $1,400
      For each 2 inch water meter: $5,750
      For each water meter over 2 inches: $10,900
      (1)   In lieu of the above connection fees there shall be an optional connection fee available for selection by owners of real estate desiring a sewer connection for buildings consisting of multi-family dwelling units located on a single parcel of real estate under one ownership but in which each dwelling unit will have an individual inch or ¾ inch or less water meter as follows: the Town Council, or its designee, shall determine the diameter size(s) of the water line or lines feeding the owner's multi-family dwelling units buildings and pay the connection fee set forth above based upon the size of the master water meter that would have been required to provide a single source water supply to the single parcel of real estate under one ownership but for the individual metering of each dwelling unit. If the owner elects to pay the connection fee under this provision, the owner shall enter into an agreement with the Town Council to promptly pay the sewer bill of any tenant within a dwelling unit that is more than one month delinquent. The Town Council is hereby authorized to make rules and regulations.
   (E)   Summer rates. In order that there be no additional sewage charge to residential users for water used in lawn sprinkling and other uses that do not enter the sewer system during the spring and summer months, the monthly sewage billing for May, June, July, and August in each year shall be determined as follows:
      (1)   The lower of actual or estimated units of water as billed by private, public or municipal water utility or acceptable town meter times 1.25 x (times) the winter average.
      (2)   Winter average shall be defined as the actual or estimated units of water used as billed by private, public or municipal water utility or acceptable town meter during November, December, January, February, and March divided by five.
      (3)   Residential users shall be defined as users of the sewage works whose premises or buildings are used primarily as a residence for one or more persons, including all dwelling units.
