§ 50.07  PRIVATE COLLECTION AND DISPOSAL.
   (A)   No person shall engage in the business of collecting, hauling, or transporting in the town any waste without first obtaining a permit from the Board of Commissioners.
   (B)   No landfill operation for the disposal of waste shall be operated within the town.
   (C)   It shall be unlawful for any person to haul, or have hauled, carried, or transported, any garbage or wet or perishable or malodorous matter of organic origin on any town thoroughfare, except in metal containers, covered vessels, or liquid-tight containers, with tight-fitting covers, all of which shall be devoid of any drain tubes, drainage pipes, or other features which will release drainings, water, seepage, or washings from the container onto public roads, streets, or property over which the transport is being moved.
   (D)   In order for an individual, partnership, corporation, or any other type of business to be eligible for a permit to remove waste from any property located within the town and to charge a fee therefor, he or she must comply with the following minimum requirements, all of which are designed for the public health, safety, and welfare of the citizens of White Lake.
      (1)   A permit must be obtained from the Town Sanitation Director upon payment of a fee determined by the Board of Commissioners, which permit shall be renewed every January 1 thereafter at an annual cost that may be changed from time to time by the Board.
      (2)   Before beginning waste collection service, a private collector must file with the town a list of its customers, the fee charged, and the schedule of pickups of waste.  This list must be refiled every 30 days in order that an up-to-date current listing is available at all times.
      (3)   Waste pickup schedules must not be any less frequent than the applicable schedules of the town.
      (4)   A vehicle designed for hauling and transporting waste may be used if it meets specifications set forth in this chapter for hauling and transporting waste.
      (5)   All permits issued pursuant to this section shall be subject to revocation if:
         (a)   Pickup schedules are not rigorously observed;
         (b)   A minimum of 5% of the customers served by a private collector file complaints with the town as to the method and efficiency of the private service; or
         (c)   Any provision of this section is not complied with.
