§ 52.088  METHOD OF DETERMINING SURCHARGES.
   The charges for excesses of the constituents listed in § 52.087 will be based upon the mass emission rate of those constituents and determined thus.
   (A)   Mass emission rate.
      MER ( ) = MG x C x 8.34
Where:
MER is the mass emission rate in pounds of a particular constituent;
MG is the millions of gallons of wastewater discharged;
C is the concentration in mg/l of the particular constituent being charged for, such as, B.O.D., C.O.D., and the like; and
8.34 is equal to the number of pounds/one gallon of water.
   (B)   The amount of the charge in dollars will be calculated thus.
Ao = R x MER ( )
Where:
Ao is equal to the amount of the charge in dollars;
R is equal to the rate of charge per pound of constituent; and
MER ( ) is equal to the pounds of a constituent.
   (C)   An example of surcharge.  Cannon’s Corporation is a producer of canned fruits.  They discharged 1,000,000 gallons of wastewater in the month of January.  Analysis found that the wastewater had the following characteristics:  B.O.D. = 400 mg/l; T.S.S. = 950 mg/l.  There were no other limitations exceeded in this example.  There were 100 employees employed at the cannery.  The limits of B.O.D. and T.S.S. are 250 mg/l.
The MER of B.O.D. is equal to:
MERBOD   = (400-250) x 8.34 x 1MG
      = (150) x 8.34 x 1
      = 1,251 lbs. of B.O.D. or 1.251
          thousand lbs. B.O.D.
If the charge for BOD is R = $380/1,000 lbs. B.O.D., then the total charge for B.O.D. is equal to, as:
   Ao   = R x MER
   Ao = $380 x 1.251
   Ao = $475.38
For T.S.S., the charge would be computed thus:
MERTSS   = (950-250) x 8.34 x 1MG
      = 700 x 8.34 x 1
      = 5,838 lbs. T.S.S. or 5.838
          thousand lbs. T.S.S.
At a charge of $50/thousand lbs., the charge for T.S.S. = 5.838 x $380 = $2,218.44
Total surcharge for January
   = B.O.D. Charge = $475.38
   = T.S.S. Charge = $2,218.44
Total surcharge for January = $475.38 + $2,218.44 =$2,693.82
