The Fire Chief of the Village of Whitehouse shall have power to modify any of the provisions of the Fire Code adopted herein upon written application by the owner or lessee, or his duly authorized and empowered agent, when in the determination of the Fire Chief there are practical difficulties or the creation of an extreme hardship would exist in carrying out the specific detail of the Fire Code. Provided, however, that the said modification or alteration shall not void the spirit of the Fire Code, nor create an issue as to public safety or security. Such modification shall be granted or allowed when so determined by the Fire Chief and shall be entered upon the record of the Bureau of Fire Prevention as determined by a written format specifying said modification or hardship and signed by the Fire Chief. A copy of such modification order shall be supplied to the applicant requesting same.
In the event that the Fire Chief shall disapprove an application or refuse to grant a modification or permit as applied for requesting such modification when it is claimed that the provisions of the Fire Code do not apply, or that the true intent and meaning of the Code has been misconstrued or wrongly interpreted, an applicant requesting modification or appeal from the decision of the Fire Chief of the Village of Whitehouse may file such formal appeal to the Court of Common Pleas, Lucas County, Ohio, within ten (10) days from the date of the decision appealed from.
