1127.10 STREET TREE REQUIREMENTS
   (a)   Prior to the approval of any final plat, a contractor/subdivider shall prepare a Street Tree Plan for review and approval by the Village Whitehouse Tree Commission. The subdivider/contractor shall be encouraged to confer with the Tree Commission prior to the preparation and adoption of said plan as to guidance and direction for said plan.
   (b)   Street trees, as defined in this Code, which shall be planted adjacent to any frontage of a subdivision lot. Trees designated in the approved Street Tree Planting Plan, shall be planted at the sole responsibility of the subdivider/contractor and shall be planted in accordance with regulations specified in Chapter 910 of this Code.
   (c)   Prior to final approval of a final plat, the subdivider/contractor shall pay a maintenance and upkeep fee as same shall be designated from time to time by the Director of Public Service and/or the Council of the Village of Whitehouse and as same shall be approved in the standardized fee schedule of the Village of Whitehouse, Lucas County, Ohio. Upon payment of the fee, the Village of Whitehouse shall hereafter plant said trees at such time as the Superintendent of Services shall determine as appropriate by taking into consideration the availability of said trees, the weather conditions, and adjacent construction activities as same shall affect said trees.
