§ 35.005 MUNICIPAL COURT FEES AND COSTS.
   (A)   In every prosecution of an offense against the municipal code, upon conviction or alternative resolution requiring payment of costs and fees, the judge shall charge the defendant with the following fees and costs.
      (1)   Generally. Every person within the town who is convicted of or pleads guilty to/no contest to a misdemeanor or traffic offense before the Municipal Court shall pay the sum of up to $80 as an administrative fee which shall be deposited into the general account of the town. The town shall specifically determine, annually, the amount of Municipal Court administrative fee to be charged in a fiscal year.
      (2)   Fees.
         (a)   Regional jail and correctional facility authority fee. In addition to the present court costs which may be lawfully imposed, an additional cost shall be imposed in an amount of not less than $42 in each proceeding, except that such additional cost shall not be assessed for a traffic offense that is not a moving violation or an offense for which the ordinance does not provide a period of incarceration.
         (b)   Administration fee. Of these $42 imposed as an additional cost, $2 shall be an administrative cost to be retained by the town for processing this fee.
      (3)   Crime Victim’s Compensation Fund. Every person within the town who is convicted of or pleads guilty/no contest to a misdemeanor before the Municipal Court, other than a traffic offense that is not a moving violation, shall pay the sum of $8 as costs in the case, in addition to any other court costs that the court is required by law to impose upon such convicted person. The court wherein such additional costs are imposed shall, on or before the tenth day of the following month, transmit all such costs received under this section to the State Treasurer for deposit in the state treasury to the credit of a special revenue fund to be known as the Crime Victim’s Compensation Fund.
      (4)   Law Enforcement Training Fund. Every person within the town who is convicted of or pleads guilty/no contest to a misdemeanor before the Municipal Court, other than a traffic offense that is not a moving violation, shall pay the sum of $12 as costs in the case, in addition to any other court costs that the court is required by law to impose upon such convicted person. The court wherein such additional costs are imposed shall, on or before the tenth day of the following month, transmit all such costs received under this section to the State Treasurer for deposit to the credit of a special revenue account for the funding of law enforcement training academies and programs.
      (5)   Teen Court Fund. Every person within the town who is convicted of or pleads guilty/no contest to a misdemeanor before the Municipal Court, other than a traffic offense that is not a moving violation, shall pay the sum of $5 as costs in the case, in addition to any other court costs that the court is required by law to impose upon such convicted person. The court wherein such additional costs are imposed shall, on or before the tenth day of the following month, transmit all such costs received under this section to the State Treasurer for deposit to the credit of a special revenue account for the teen court program.
   (B)   Any changes in the court costs and fees mandated to be charged by circuit, magistrate, and municipal courts by the state legislature are hereby automatically adopted as they occur.
