(A) The Town Council hereby establishes a photocopying charge or reproduction fee of $0.75 per page, per side.
(B) This section is to be interpreted and applied consistent with the West Virginia Freedom of Information Act, being W. Va. Code §§ 29B-1-1 et seq., where applicable, and any “non-paper” or electronic reproduction shall be subject to a similar charge based upon the volume of data or information stored by said means.
(C) To the extent that the town becomes subject to a Federal FOIA request, pursuant to 5 U.S.C. § 552, or similar federal laws, the Mayor or his or her designee shall provide for fees similar to and consistent with this section until a similar superseding and applicable ordinance can be enacted.
(D) The Town Administrator is the designated public records custodian.
