Any person who violates § 130.02 is guilty of a misdemeanor, and, upon conviction thereof, shall be fined not more than $500 or imprisoned not more than 30 days or both fined and imprisoned. A person convicted of a second or subsequent offense is guilty of a misdemeanor, and, upon conviction thereof, shall be fined not more than $1,000 or imprisoned not more than six months or both fined and imprisoned.
