(A) In any instance in which a purchase of supplies, materials, and equipment by the town is required to be made upon competitive acquisition and such purchase is upon competitive sealed bid, then such purchase shall be made from a resident vendor, provided such bid does not exceed the lowest qualified bid from a nonresident vendor by more than 5%.
(B) A vendor shall be deemed to be a resident of the town if such vendor is an individual, partnership, association, or corporation that maintains an active bona fide place of business within the town and has been in the town for the four years immediately preceding the date on which the bid is submitted, is licensed to do business by the town, and pays the business licensure fees and is otherwise current in its payment of all fees required to be paid by the business.
