§ 70.12 ABANDONED AND JUNK VEHICLES.
   (A)   No person shall abandon any motor vehicle within the town. No person shall leave any motor vehicle at any place within the town for such time and under such circumstances as to cause such vehicle to appear to have been abandoned.
   (B)   No person shall leave any unlicensed, partially demolished, non-operating, jacked, or junked motor vehicle on any street, lane, or any other public property within the town.
   (C)   No owner of any property within the town or any person in charge of control of any property within the town, whether as owner, tenant, occupant, or otherwise, shall allow any partially dismantled, non-operating, wrecked, junked, or discarded motor vehicle to remain on such property for more than 72 hours. No person shall leave any such vehicle on any property within the town for more than 72 hours.
   (D)   This section shall not apply to any vehicle stored or placed in an enclosed building, nor to any vehicle on the premises of a business enterprise operated in a lawful place and manner, and when the location of each subject vehicle thereat is absolutely necessary to the operation of such business enterprise.
   (E)   When any motor vehicle has been abandoned or junked on private or public property as provided in this section and/or in W. Va. Code §§ 17-24A-1 et seq., police officers are authorized to provide for removal and impounding of any such vehicle. When such vehicles are on private property, before such vehicles are removed and impounded, the owner of any such private property within the town or any person in charge or control of any such private property within the town, whether as owner, tenant, occupant, or otherwise, shall be notified to remove such vehicle within five days, and if such vehicle is not removed within such time period, it may be removed and impounded as stated above.
   (F)   Any vehicle that has been removed and/or impounded under division (E) above shall be disposed of as provided under W. Va. Code § 17-24A-1 et seq. and this chapter.
