§ 95.02 PROHIBITED ACTS.
   The following acts, among others, are declared to be loud, disturbing and unnecessary noises in violation of this section, but this enumeration shall not be deemed to be exclusive.
   (A)   The sounding of any horn or signal device on any automobile, motorcycle, bus or other vehicle while not in motion, except as a danger signal if another vehicle is approaching, apparently out of control, or if in motion, only as a danger signal after or as brakes are being applied and the deceleration of the vehicle is intended; and, the creation by means of any such signal device for an unnecessary and unreasonable period of time; and,
   (B)   The loud playing of radios, stereos, televisions, tape decks, amplifiers, loudspeakers, musical instruments, vehicle alarm systems or other devices not enumerated here, but which cause loud or irritating noises which are plainly audible from a distance of 50 feet from its source, or in such a manner as to annoy or disturb the quiet comfort or repose of persons in any dwelling, motel, medical office, or other type of residence, or of any persons in the vicinity, particularly between the hours of 10:00 p.m. and 7:00 a.m.; and,
   (C)   Yelling, shouting, hooting, whistling or singing on the public streets, particularly between the hours of 10:00 p.m. and 7:00 a.m., or at any time or place so as to annoy or disturb the quiet, comfort or repose of any person in any hospital, medical office, dwelling, motel or any type of residence, or any person in the vicinity; and,
   (D)   The keeping of any animal, bird or fowl which by causing frequent or long continued noise shall disturb the comfort or repose of any person in the vicinity; and,
   (E)   The use of any automobile, motorcycle or vehicle, so out of repair or so loaded, as to cause loud and unnecessary grating, grinding, rattling or other noises; and,
   (F)   To discharge into the open air, the exhaust of any mechanical or electrical engine, stationary internal combustion engine, motor vehicle or motor boat engine, except through a muffler or other device, which will effectively prevent loud or explosive noises therefrom.
   (G)   (1)   It shall be unlawful for the driver of any motor vehicle to use, or to operate, or cause to be operated upon the streets or highways within the city limits, any mechanical exhaust or decompression which results in the practice commonly known as “jake-braking” or “engine-braking.”
      (2)   ENGINE-BRAKING/JAKE-BRAKING. The use or operation of any mechanical exhaust device designed to aid in the braking, decompression, or deceleration of any motor vehicle which results in the excessive, loud, unusual, or explosive noise from such vehicle.
      (3)   The city street department is hereby authorized to post, at reasonable locations, signs which indicated the prohibition of engine-braking and/or jake-braking.
