(A) Whoever violates any provision of this chapter for which no specific penalty is otherwise provided shall be subject to the penalty in § 10.99.
(B) Whoever violates the provisions of § 94.02 shall be fined as follows:
(1) First offense: written warning.
(2) Second offense: $50 fine plus city court costs.
(3) Third offense: $100 fine plus city court costs.

(C) The failure of any person, firm, corporation, governmental entity, or association of any kind to comply with the provisions of §§ 94.11 through 94.18, shall result in a penalty not to exceed $5,000 and a premium fee equal to twice the amount of any permit fee required by this subchapter. Failure to comply means that a person, firm, corporation, governmental entity, or association of any kind, fails to seek a permit to bore, excavate, lay conduit, or place equipment in any public right-of-way prior to beginning such activity.
(D) Whoever violates the provisions of § 94.25 shall be deemed guilty of a misdemeanor and shall be punished upon conviction in any sum not less than $1 nor more than $15 and each day that said condition shall exist shall be considered a separate offense. (Ord. 51, passed 8-24-71)
