(A) All persons who enter or remain on any property which is a part of the City Park System shall use and enjoy the same for its intended purpose. Should any person engage in any conduct which would constitute a violation of state criminal statutes, city or county ordinances, or otherwise loiter, engage in misconduct or assemble with one or more persons for no legitimate purpose, they shall be in violation of this section.
(B) Any certified police officer may, at their discretion, cite juveniles for any criminal violation to the juvenile court and cite any adult for a criminal violation to a court of competent jurisdiction.
(C) As an alternative to or in addition to any criminal charges brought in a court of law, a police officer may direct any violator of this section to leave the City Park System; and,
(1) If the violator is a juvenile, the officer shall provide a written warning to the parent or legal guardian, with a copy of the same to the Mayor. The parent or legal guardian shall be informed that the juvenile shall not again be allowed to re-enter the park property until approved to do so by the Mayor.
(2) If the violator is an adult, the officer shall provide them with a written warning, with a copy of the same to the Mayor. They shall be informed that they shall not again re-enter the park property until approved to do so by the Mayor.
(D) The Mayor, after reviewing the facts attendant to the violation of this section, may prohibit the use of the City Park System for a period not to exceed 90 days for a first offense, and for a period not to exceed one year for a second offense. Any juvenile or adult who regularly participates in scheduled activities may be permitted to re-enter the City Park System to participate in that activity but shall immediately thereafter leave. If the person is a juvenile, they must be accompanied by a parent or legal guardian under this exemption. In addition to other powers granted, the Mayor may prohibit the violator's use of a motor vehicle within the City Park System.
(E) Any parent or legal guardian whose juvenile child shall enter or remain unlawfully upon city park property without the consent of the Mayor shall be in violation of this section and subject to a fine not to exceed $100.
(F) Any juvenile or adult who has been issued a warning/notice pursuant to this section and who has not been approved for re-entry or has been excluded from use of the City Park System, and who
re-enters park property, shall be guilty of criminal trespass and may be cited for such a violation in a court of competent jurisdiction.
(G) Any parent or legal guardian on behalf of a juvenile or any adult who has been excluded from the City Park System for more than 14 days may appeal the action of the Mayor to the City Council. This appeal must be filed within five days of any order issued by the Mayor and filed with the City Clerk.
