161.15 VACATION LEAVE.
(a) All full-time employees of the City will commence earning vacation credit upon employment in accordance with the schedule in this section; however no vacation time may be used until an employee has completed one month of continuous full-time employment with the City.

(1) Employees are entitled to take vacations in any multiples of two hours or more to the limit to which they are entitled with approval of department head or appointing authority.
(2) Overtime hours worked shall not be used in computing vacation leave accrual.

(b) An employee's anniversary date (last hire date) will be utilized for purposes of determining eligibility in computing earned vacation. Only earned vacation may be used. An employee with one year or more service may take all earned vacation upon approval.

(2) Employees of the Police and Fire Department, who are members of the bargaining unit, shall earn vacation at the rate and upon satisfaction of conditions stated within the current collectively bargained contract. Management personnel of the Safety Forces (PO3/FF4 and PO5/FF5) shall earn vacation as stated within subsection (b)(1) hereof.

(3) The provisions of Ohio R.C. 9.44, as well as years of full-time service with the City, shall be utilized in computing vacation years of service eligibility. An employee's vacation year is based on his/her anniversary date of hire with the City and extends from anniversary date to anniversary date.
(4) All vacation shall be requested by the employee and approved by the department head. Vacation time shall be noted on time cards prior to submittal to the Auditor. The Auditor shall not post vacation time on an employee's record until the time is earned.

(c) A recognized holiday, defined in Section 161.11, falling within the vacation leave period shall not be considered as a working day for computation of the leave period. An extra day may be taken either the day prior to, or the day following the vacation leave.
(d) In the event of an employee's death while in paid status, any unpaid overtime or holiday work time and vacation leave as provided in Section 161.11, 161.12 and this section respectively to his credit shall be paid to the estate of the deceased, unless the employee shall expressly direct otherwise by filing a written declaration with the Auditor designating the payment beneficiary.
(e) An employee who is about to be separated from service through discharge, resignation, retirement or layoff, and who has unused vacation leave to his credit, shall be paid in a lump sum for such unused vacation leave in lieu of granting such employee a vacation leave after his last day of active service with the City.
(f) An employee who resigns without giving at least ten calendar days prior written notice shall forfeit any unused vacation leave to his credit, or pay in lieu thereof, on the date of resignation, at the discretion of the appointing authority.
(g) Unless otherwise provided by a collectively bargained contract, any employee who has completed at least one year of full-time service from date of initial appointment with the City will be entitled to vacation pay for all unused vacation upon termination of employment with the City. Vacation entitlement for less than a complete year's service will be based on the schedule provided in subsection (b)(1) or (3) hereof.

(h) Employees may accumulate and carry over from year-to-year a maximum of eight hundred fifty (850) hours of accumulated but unused vacation leave. Vacation balances in excess of eight hundred fifty (850) hours as of December 31 of each calendar year shall be forfeited.
(i) Employees may not take more than one continuous six week vacation in any three year period.
(j) Accrued vacation leave, compensatory time or personal leave may not be used to extend an employee’s retirement/resignation date except in extenuating circumstances as determined and authorized by the Board of Review.
