916.09 HAZARDOUS TREES AND SHRUBS.
(a) On any property within the City of Whitehall, no person shall maintain or permit to stand, any tree or shrub designated dead, diseased or deemed a menace to health, safety and welfare of the people or urban forest of Whitehall.
(b) In the case that the tree has not been addressed properly by property owner, the City Administrator or their Agent shall order removal of such tree or shrub identified as dead, diseased or a menace, by a letter sent by first class mail to the last known address of the property owner. A period of no more than thirty days will be permitted to affect such removal. When a person or persons to whom an order is directed shall fail to comply within the specified time, it shall be lawful for the City to remove such tree(s) and/or shrub(s) and assess costs as provided in Section 517.23
of the Health, Safety and Sanitation Code.
