916.01 DEFINITIONS.
   For the purpose of this chapter the following terms, phrases, words and their derivations shall have the meaning given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural include the singular, and words in the singular include the plural. The word "shall" is mandatory and not merely directory:
   (a)    "Person" means any person, firm, partnership, association, corporation, company or organization of any kind.
   (b)    "Street" or "highway" means the entire width of every public way, easement or right of way when any part thereof is open to the use of the public, as a matter of right, for the purposes of vehicular and pedestrian traffic, and shall include alleys.
   (c)    "Public places" include all other grounds owned by the City.
   (d)    "Property line" means the outer edge of a street or highway.
   (e)    "Property owner" means the person owning such property as shown by the County Auditor's Plat of the City of Whitehall, Franklin County, Ohio.
   (f)    "Treelawn" means that part of a street or highway not covered by sidewalk or other paving, lying between the property line and that portion of the street or highway usually used for vehicular traffic.
   (g)   "Tree" means a tall growing woody plant with one of more perennial main stems or trunk which develops branches from the aerial section of the stem rather than from the base; capable of being pruned to as least six (6) feet of clear branch less trunk below the crown within five (5) years of planting.
   (h)   "Public trees" mean all shade and ornamental trees now or hereafter growing on any street, highway or any public places.
   (i)   "Large trees" mean those attaining a height of forty-five (45) feet or more.
   (j)   “Medium trees" mean those attaining a height of thirty (30) to forty-five (45) feet.
   (k)   "Small trees" mean those attaining a height of twenty (20) feet to thirty (30) feet.
   (l)   "Shrub" means a low growing woody plant with several perennial stems instead of one (1) trunk, producing branches, shoots or multiple stems from or near the base of the plant and incapable of being pruned to provide at least six feet of clear branch less trunk within five (5) years of planting.
   (m)   "Evergreen" means any tree that retains its green living foliage the entire year.
   (n)   “Principal thoroughfare" means any street upon which trucks are not prohibited.
   (o)   "Right-of-Way" means any portion of the public way, street. alley, or sidewalk.
   (p)   "City Administrator or their Agent" is the City Administrator or employee hired by the City of Whitehall charged with the administrative duties of the City related to Right of Ways.
   (q)   "Tree Topping" means the severe cutting back of limbs to stubs of three (3) inches or more in diameter within the tree's crown to such a degree as to remove the normal canopy and disfigure the tree.
   (r)   “DBH" (diameter at breast height) is the diameter in inches of the stem of a standing tree at four and one-half (4.5) feet above the ground level,
