533.14 SOLICITING OR ATTEMPTING TO PURCHASE OR OBTAIN A DANGEROUS DRUG OR COUNTERFEIT CONTROLLED SUBSTANCE.
   (a)   No person shall solicit to purchase, offer to barter, or exchange any item or service or thing of value, to solicit or suggest that it be given as a gift, any dangerous drug. As used in this section, Adangerous drug" means the same as defined in Ohio R.C. 4729.02.
   (b)   No person shall solicit to purchase, offer to barter, or exchange any item or service or thing of value, to solicit or suggest that it be given as a gift or for value, any counterfeit controlled substance as used in and defined by Section 533.01(gg).
   (c)   Any law enforcement official may solicit, or offer to purchase, or may purchase or possess dangerous drugs or counterfeit controlled substances when necessary to do so in the performance of his official duties. A law enforcement officer, as defined in Ohio R.C. 3719.141, may solicit or offer to purchase or may sell a dangerous drug or counterfeit controlled substance in the performance of his official duties, either directly or through use of an informant or agent, but only as provided in Ohio R.C. 3719.141.    (d)   Whoever violates subsections (a) or (b) hereof is guilty of a misdemeanor of the first degree. (Ord. 31-92. Passed 4-7-92.)
