(a) Whoever violates any provision of the rules and regulations approved under Section 167.01 shall be fined not more than five hundred dollars ($500.00) or imprisoned not exceeding thirty days, or both.
(b) In addition to, or in lieu of the above penalty, any person who violates any of the rules and regulations may be requested to leave the park premises. If such person refuses to do so, he will be subject to punishment under subsection (a) hereof.
(c) Any person who is found to be a repeat offender of the rules and regulations of the park may be banned from the park for such period as may be specified by the Park Manager. Such ban shall take effect upon written notice to such offender, who shall have the right to appeal such ban to the Board of Review and Appeals within ten days from receipt of such written notice, by serving written notice of such appeal on the Park Manager. Such notice shall be transmitted to the Board, which Board shall arrange for a hearing on such ban and appeal. The hearing shall be held within ten days of the receipt of the notice of appeal by the Board and the decision of the Board shall be given in writing within five days from date of the hearing.
(d) There is hereby created a Board of Review and Appeals consisting of three members to be designated and appointed by the Wheeling Park Commission who shall serve at the will and pleasure of the Wheeling Park Commission. Two of such members shall be residents of the City, and no member shall be an employee of the Wheeling Park Commission.
