159.27 REINSTATEMENTS.
Any person who has held a permanent position in the classified service by appointment under these Rules and Regulations, and who has been separated from the service through no delinquency or misconduct on his/her part, may be reinstated without re-examination, if in the opinion of the Commission re-examination is not necessary. Such reinstatements may only be made in a vacant position in the same department within one year from the date of separation. Individuals may not be reinstated in a higher ranking or paid position than that which was previously held.
For voluntary quit reinstatements, an employee shall lose all seniority rights, longevity and accrued benefits. The employee shall return at the minimum salary and shall be required to serve a six months probationary period. The employee may repay pension monies in accordance with the pension provisions. Should an employee repay his/her pension monies, it shall not entitle such employee to regain previous seniority rights, longevity and accrued benefit levels.
For lack of work or reduction in force reinstatements, the employee shall be reinstated at the same status as at time of termination. The employee will lose any benefits for which he/she was paid at time of separation. The employee must repay all pension monies in accordance with the pension provisions.
