159.09 EXAMINATIONS AND ELIGIBLE LISTS.
   (a)   Nature of Examinations; To Whom Open; Notice of Holding; Open to Press; Posting Eligible Lists. The Civil Service Commission shall, as a need arises, hold examinations or tests for the purpose of establishing employment or eligible lists for the various positions in the classified service.
   All examinations for appointment to positions or for promotions shall be practical in their character and shall relate to such matters, and include such inquiries as will fairly and fully test the comparative merit and fitness of the person examined to discharge the duties of the employment sought by such person. All examinations shall be open to applicants who have fulfilled the preliminary requirements provided by this article and the rules and regulations of the Commission. Adequate public notice of the time and place of every examination for original appointment held under the provisions of this article, together with information as to the nature of the position or place to be filled, shall be given at least one week prior to such examination.
   The Commission shall post, in a public place at the office of the City Clerk the employment or eligible lists containing the names and grades of those who have passed examinations for positions in the classified service of the City under this article, and shall indicate thereon such appointments as may be made from such lists. However, when two or more eligibles shall have the same average score, the ranking on the list shall be determined by lot. As appointments are made from the eligible list, the Personnel Director shall remove such names from the eligible list in question. The term of the eligible list is fixed at two years from the date the Commission approves such eligible list.
   (b)   Physical Examinations. All applicants for original appointment in the classified service shall undergo a physical examnation, which shall be conducted under the supervision of a licensed physician in a manner prescribed by the Civil Service Commission.
   (c)   Questions Relating to Religious or Political Opinions Prohibited. No questions in any test or examination, or on the application shall relate to religious or political opinions or affiliations.
   (d)   Consideration of Seniority and Service Record in Examination for Promotion. In all examinations for promotions, due consideration shall be given to the performance record of each candidate as shown in the records of the department, City or of the Civil Service Commission.
   (e)   Rules Applicable to Veterans. A veteran may file with the Commission a certificate of service, whereupon he/she may receive veteran’s preference points in accordance with West Virginia Code 6-13-1 on any entry-level examination in which a passing grade has been received.
