Employees injured or incapacitated in the actual discharge of duty, who are compelled to be absent from duty, shall be eligible to receive Workers’ Compensation benefits as approved and required by West Virginia Workers’ Compensation. No employee shall be eligible to receive any leave benefits from the City during any time period in which Workers’ Compensation benefits have been filed. Employees shall not lose any seniority or service credits while off work due to a compensable injury.
